  • Customer: Any individual, business, or entity owing a debt to ZFO or its clients.
  • Personal Information: Information that identifies you, like your name or contact details.

How We Collect Personal Information

We collect information in these ways:

  • Directly from you: Via phone, forms, or in-person interactions.
  • From clients: When they engage us to recover debts.
  • From third parties: Such as credit agencies, verification databases, or your representatives.
  • From public sources: Like directories or online records.
  • From our records: Based on your interactions with our services.

We only collect what’s necessary and use fair, lawful methods. Where practical, we’ll collect it directly from you and let you know what we’ve gathered, even if it comes from someone else.

What Information We Collect

Depending on the service, we may collect:

  • Basic details: Name, address, phone number, email.
  • Financial data: Account balances, payment history, credit reports.
  • Transaction records: Details of your dealings with us or third parties.

For sensitive information (e.g., health or criminal records), we’ll seek your consent unless legally required otherwise.

Why We Collect It

We use your information to:

  • Recover debts and manage accounts.
  • Process payments and service client requests.
  • Assess creditworthiness or investigate fraud.
  • Improve our services and respond to inquiries.
  • Meet legal or regulatory obligations.

How We Protect Your Information

  • Access: Only trained, authorized staff handle your data. Breaches of this policy lead to disciplinary action.
  • Security: We use reasonable measures (e.g., encryption, secure storage) to protect your information.
  • Third Parties: We share data only with your consent, as disclosed here, or when required by law. Third parties must meet our privacy standards, and we monitor their compliance through contracts and audits.

Retention: We keep your data only as long as needed for our purposes or legal requirements. Afterward, we securely destroy or de-identify it.

Your Privacy Rights

Under the Privacy Act 1988 and Australian Privacy Principles (APPs), you have the following rights, which we uphold through our processes (IMS Section 16):

  • Ask What We Hold: You can request details about what personal information we hold, why we hold it, and how we use it. Where we have collected your personal information from third parties (e.g., credit agencies, clients), we will notify you as soon as practicable, unless exempt under APP 5 (e.g., where notification would prejudice an investigation).
  • Access Your Data: You can request a copy of your personal information (e.g., account statements, loan contracts) within 15-20 days of your request, subject to legal exceptions (e.g., emergencies, law enforcement needs). Requests are processed by the Privacy Officer, and a small administrative fee may apply for complex requests, per IMS Section 18.2.
  • Correct Errors: If your information is inaccurate, incomplete, or outdated (e.g., incorrect address), notify us, and we will update it promptly, informing relevant third parties where required by APP 13.
  • Interact Anonymously: Where lawful and practical, you can deal with us without identifying yourself (e.g., general enquiries), subject to limitations for debt collection processes.

To exercise these rights, contact our Privacy Officer (details below). We will verify your identity for security purposes and respond within 15-20 days, ensuring compliance with APPs. If we cannot meet your request (e.g., due to legal exemptions), we will provide a written explanation.

Sharing Your Information

We may disclose your personal information to:

  • Clients, to recover debts on their behalf, with their agreement to comply with APPs.
  • Credit agencies or legal authorities, as required by law (e.g., ASIC, AUSTRAC).
  • Service providers (e.g., IT or audit firms) under strict privacy agreements, monitored through contracts and audits to ensure APP compliance.

We do not share your data overseas unless necessary for a service (e.g., client-directed debt collection), in which case we ensure APP-compliant protections (e.g., contractual safeguards). For client-specific accounts, data sharing may follow client-directed processes, per the ZFO Client-Specific Debt Collection Procedures (IMS Section 18.2).

Data Accuracy

We strive to keep your information accurate and up-to-date. Please notify us of any changes (e.g., new address, phone number) to help us maintain correct records, per IMS Section 16. Updates are processed within 15-20 days, with confirmation provided via Email, SMS, or phone, per Spam Act 2003.

Complaints

If you believe we have mishandled your privacy, contact our Privacy Officer. We will investigate and respond within 14 days, resolving any valid issues and updating our practices if needed, per the Complaint Handling Policy (IMS Section 11.4).
